GDPR is all about Opt In not Opt Out
One of the key points about GDPR is that it changes the onus on consent. It changes it from implied consent to clear and unambiguous consent that is freely given.

What happens if someone did not read their emails. Does this mean that they have given clear and unambiguous consent? Will this hold up if you are challenged by the Information Commissioner?

I think not.

The only way to ensure that people give consent is to ask them to give it in a way that is clear and unambiguous (no pre-ticked boxes).

We did our consents last year and have over 15,000 readers who have updated their consent. But we have a largish number who have not updated their consent and will be removed from our mailing list next week.
